What is a Fiduciary?

A fiduciary is a person who assumes a position of responsibility, obligation, and trust to act for another’s benefit. Fiduciaries may serve by court appointment or under private agreement.

Court Appointment

Conservatorship, also referred to as guardianship, is a legal process, utilized when a person can no longer make or communicate safe or sound decisions about his/her person and/or property or has become susceptible to fraud or undue influence.

The court may limit the conservator’s authority in any type of conservatorship. The guiding principle in all conservatorships is that of least intrusive measures to assure as much autonomy as possible and the use of Supported Decision Making (SDM), a means for increasing self-determination by encouraging and empowering people to make their own decisions about their lives to the maximum extent possible.

Conservatorship of the Person

The court appointed conservator of the person may be assigned the following responsibilities:

  • Determine and monitor residence.
  • Consent to and monitor medical treatment.
  • Consent and monitor non-medical services such as education, counseling, in-home care, and other services.
  • Consent and release of confidential information.
  • Make end-of-life decisions.
  • Report to the court about the conservatee.

Guardianship of the Estate or Property

The court appointed conservator of the estate is assigned the following responsibilities:

  • Marshall and protect assets.
  • Obtain appraisals of property.
  • Protect property and assets from loss.
  • Receive income for the estate.
  • Make appropriate disbursements.
  • Obtain court approval prior to selling any asset.
  • Report to the court an accurate accounting of funds and other status of the estate.

Private Agreement

With the aid of the client’s attorney, an agreement is drawn up detailing the authority to act in defined capacities on the express wishes for future care and/or estate management. We utilize only licensed, certified, and insured professionals to support the following private services:
